Is bail required if quashing is under way?
25-Apr-2023 (In Criminal Law)
I had an FIR against me as part of a cross case. I applied for quashing and High court has sent the case to mediation for cross case quashing. Next date for quashing hearing is in July.I've the next date in lower court which was scheduled earlier to be on 27th April. Would I still need to apply for bail bond?
Greetings,
until and unless high court has provided stay on your arrest in the quashing proceedings, you need to file the bail bond. In failure to file bail bond you might get arrested. rest depends on the sections that are booked under in FIR

That depends as to at what stage is your case at. whether chargesheet has been filed or not? if yes, charges have been framed or not? whether any indulgence of teh police officer as to the investigation is required? Stage of quashing petition. observation by the judge as to the prima faciness of the matter. All that when kept in a factor will decide whether bail is required or not.
if high court has not stayed the trial court proceeding then on appearance you shall be required to complete formalities for bail if offense involved is bailable otherwise you have to apply bail from sessions court.
