conversation between advocate and client is a privileged conversation, it cannot be used as evidence and it is difficult to prove in court, that you are the person talking on the record and that too if it is recorded without consent, file a case against the advocate for criminal breach of trust, civil suit for damages bar council complaint and a writ petition for advocate depriving you from your right

If a case under Indian Penal Code Sections 385, 500, and 34 was filed before March 2025 (about 2 years ago), here is the legal understanding: Sections involved Section 385 of the Indian Penal Code – Putting a person in fear of injury in order to commit extortion. Section 500 of the Indian Penal Code – Defamation. Section 34 of the Indian Penal Code – Acts done by several persons with common intention.

You should immediately disengage from the present advocate and appoint a new independent advocate to protect your interests. If an advocate representing you has secretly recorded discussions and then used that conversation to make an extortion demand, it raises very serious issues of professional misconduct, breach of trust, and possible criminal intimidation/extortion. Since the advocate was representing both you and the hospital, this may also amount to a conflict of interest, which is against professional ethics. Your new advocate can properly examine the recording, your NCR, and all surrounding circumstances and then take appropriate steps such as filing a formal police complaint for extortion, as well as initiating disciplinary proceedings before the Bar Council for professional misconduct. Do not continue communicating with the same advocate in this matter. Collect and preserve all evidence (messages, recordings, call details, etc.) and proceed legally through a different advocate to safeguard your rights

This represents a serious conflict of interest and extortion. Immediately file an FIR for extortion with the police and submit a professional misconduct complaint to the State Bar Council as per the concerned provisions of law.
