date and time of offence in charge sheet is 3 sept 2013 ,8 pm but on that day i was present at gonda dis . on my ralway duity time 8 am to 4 pm .althow this case has resisterd and stil pending. can i re inquriy my case from high court allahabad ?

Yes you can challenge the charge sheet if the cognizance on the charge sheet has been taken and this aspect has not been investigated and you have been able to bring this fact on record i.e. the case diary. But my friend my legal acumen says that the defence cannot be taken into account while taking cognizance or discharge.
