in ongoing 319 crpc crl mp petition in ongoing cc case mm court The respondents/accused have filed their counter statement to the application . court has noted that the matter is now at the stage of hearing the petitioner’s side in response to that counter. counter is filed with no evidence just mere denial and misinterpretation of law quoted . Reply to counter also filed by petitioner .For petitioner and Respondent side enquiry adjourned to meaning of both side enquiry

In a petition under Section 319 CrPC, both sides are generally heard before the Court decides whether any additional accused should be summoned. “Petitioner side enquiry” means arguments/evidence by applicant. “Respondent side enquiry” means objections and defence by proposed accused/respondents. Mere denial in counter is not sufficient if record already shows strong evidence against proposed accused. The Court will examine complaint, witness statements, cross-examination and material on record to see whether a prima facie case exists. If sufficient evidence appears, Court may issue summons/process against additional accused despite objections filed by respondents.

“Both side enquiry” means the court will hear arguments/submissions from petitioner and respondents on the 319 CrPC application before deciding whether additional accused are to be summoned as the concerned provisions of law.
