warrant case based on police report (like 498A/406 IPC), the court is required to consider the discharge application under Section 239 CrPC before proceeding to arguments on charge. If your discharge application is pending and has not been adjudicated, you can: Move a written application before the same court requesting disposal of the discharge application prior to hearing on charge. Seek a reasoned order—the court is bound to pass an order (even if brief), not necessarily on each ground separately, but reflecting application of mind. If the court still proceeds without deciding discharge, you may consider filing a revision petition before the Sessions Court challenging the procedural irregularity. Contact me for minimum fees

I believe that the discharge application will be decided on the next date as the matter is still on argument of charge. however if you believe that the judge is being biased towards you, you may file an application seeking transfer of your case to another judge stating all the relevant grounds

In your case, the course of action needs to be strategic and legally precise rather than immediately seeking transfer of the case. At the outset, it is important to understand that a discharge application filed under the relevant provisions of the Code of Criminal Procedure (depending on whether it is a warrant case instituted on police report or otherwise) must be considered and decided by the Trial Court before proceeding to the stage of framing of charge. The court is expected to apply its judicial mind and pass a reasoned (speaking) order on the discharge application based on the material on record. If the learned Trial Court has listed the matter for arguments on charge without formally disposing of your discharge application, this amounts to a procedural irregularity. However, this by itself does not automatically justify seeking transfer of the case. In the present situation, the following steps are advisable: First, you should immediately file a formal application or a detailed written submission before the Trial Court bringing on record that your discharge application is pending and has not yet been adjudicated. In that application, you should specifically pray that the court may be pleased to decide the discharge application by a reasoned order prior to proceeding further with arguments on charge. Second, at the time of hearing, your counsel should clearly press this issue and request the court to first adjudicate the discharge application. The court is legally bound to consider whether a prima facie case is made out before framing charges, and therefore cannot bypass the discharge stage. Third, if despite such request the Trial Court proceeds to frame charges or refuses to pass a reasoned order on the discharge application, you may challenge such action by filing a Revision Petition before the Sessions Court or the High Court, as the case may be. Alternatively, you may invoke the inherent jurisdiction of the High Court under Section 482 CrPC seeking directions to the Trial Court to decide the discharge application in accordance with law. As regards filing a transfer application before the District Judge, the same is generally maintainable only when there is a reasonable apprehension of bias, lack of fairness, or likelihood of miscarriage of justice. Mere procedural lapse or non-consideration of an application, without more, is usually not sufficient ground for transfer. Courts are cautious in allowing transfer petitions and require strong material to demonstrate prejudice. Therefore, at this stage, the more appropriate and effective remedy is to insist upon adjudication of your discharge application before the Trial Court itself, and if necessary, challenge any adverse or improper procedural action through revision or proceedings before the High Court. In summary, you should first exhaust remedies before the Trial Court, and only thereafter consider approaching higher forums. A transfer application should be treated as a last resort and not the primary remedy in the present facts.

In many instances these days, the judges will reject the discharge application on the very same day on which the framing of charges is done. I have dealt with such issues even in POCSO matters. yes you can file application for transfer but i don’t have much information about the case so i can’t really comment that what would be next plan of action.

Greetings. Will give you the reply in short and to the point The discharge application seems to be pending disposal. I reckon it will be decided on the next date before framing of charges under the relevant provisions. Do press for disposal. In case the court frames the charges without disposal of your application You may file a revision before the sessions. Do file a written application before the next hearing seeking disposal of discharge application so that the court will be bound to give a reasoned order on that. And in case the court dismissed your application you may file a revision
