Illegal possession of hotel materials by a friend what to do

My friend opened an restraurant in ghaziabad but in may 2016 he closed due to heavy loss.he sent his material to himachal pardesh but his close relative who was living in his house kept his material at their house saying that as we are living in your house let your material be in my house.my friend was working in delhi and when he came to himachal and ask about his material,they are asking heavy rent on it.what to do? He went to police station but they refuse to write an fir as the material belong to ghaziabad. Are they talking sence?

I could understand that the house where the relatives are living in ghaziabad and the same people having their own property in Himachal Pradesh where your friend kept his material. There are two places where complain can be lodged. One where cause of action arose or where the defendant leaves...

Firstly elaborate your question. its confusing. Who's house is it in gaziabad? SECONDLY FIR cannot be denied by police on basis that material is of gaziabad. IF FIR is denied then immediately write to SP that local police is not lodging FIR. Do attach copy of FIR which is not being registered. After this go to some advocate and file case u/s. 156 (3) CrPC in civil court.

Hello dear client, You can file a case under Sec 406 IPC . If police refused to register your case you can ask for the help of your learned council to register your case with the help of Court under sec 156(3) Cr.P.C.
