I would like to get guidance around a case.

I've a relative who is arrested for a wrongful crime. He has been in the prison for the last 3 months. Their family was waiting for the chargesheet to be filed and now it has been filed. I want to know if we can apply for bail and how can we go about proving him innocent?

yes you can file for a bail, once you secure the bail then you can fight for quashing of the case, or fight the case on its merits by facing trial, you haven't mentioned the relevant sections in which you have been implicated, but generally bail is the rule and jail an exception.

Please specify which crime first and was it on a complaint or FIR? If the charge sheet has been filed you will be given a change to object to the charges that have been filed after Sec 244 crpc stage has been concluded by the court. Please get in touch for discussion.
