How to file a case. (We know eachother from last 12years).
In your case, multiple legal remedies are available based on the situation. Here’s how you can proceed:
1. File a Criminal Case
Under IPC Section 376 (Rape on False Promise of Marriage)
If he had sexual relations with you by falsely promising marriage and now refuses, you can file a case for rape under Section 376 IPC. Courts have recognized that if a man makes a false promise of marriage solely to exploit a woman sexually, it can be treated as rape.
Under SC/ST (Prevention of Atrocities) Act (if applicable)
If he used caste-based slurs or denied marriage due to caste discrimination, you can file a case under the SC/ST Prevention of Atrocities Act (if you belong to SC/ST).
2. File a Complaint for Threats & Intimidation
Under IPC Sections 506 & 509 (Criminal Intimidation & Insulting Modesty of a Woman)
If he is threatening or blackmailing you, you can file a police complaint for criminal intimidation.
3. File a Complaint in Army Authorities
Since he is in the Indian Army, you can report his misconduct to his superiors or the Army Human Rights Cell. The Army takes strict action against officers who engage in moral or criminal misconduct.
4. File a Civil Suit for Damages
If you suffered emotional, social, or financial harm, you can file a civil suit for compensation for mental harassment and betrayal.
Steps to File a Case:
1. Go to the nearest police station and file an FIR mentioning:
His name, rank, and service details (if known).
The nature of the relationship and false promises.
Threats and caste discrimination, if applicable.
2. Consult a lawyer to file a petition in court if the police do not take action.
3. Approach the Army Complaint Cell if you want disciplinary action from his workplace.
