I want to file an application before the Hon'ble Court.


18-Oct-2023 (In Criminal Law)
I am an accused in a criminal case under section 323, 342, 376, 376(n)2 IPC & 6 POCSO Act. I want to know a public witness in my case namely xyz. Victim had stated she left his house for 17 days and she stayed one of her friends namely xyz in chargesheet. Victim is miner but his friend is adult. Can I file an application against xyz for the addition of accused under section 363 IPC?

yes under 319 of the Criminal procedure code the Trial court has the power to add any accused if it appears from the evidence that any person not being the accused has committed any offence for which Such person could be tried together with the accused, the court may proceed against such person for the offence which he appears to have committed. Also depends upon the credibility of the evidence which you currently possess.
