I recieved a notice from police to appear regarding a FIR

24-Oct-2025 (In Criminal Law)
I have recieved a notice from the police of my local police station that shows that I have made some comments on Facebook which comes under BNS 302 and IT Act 66B. It was based on an FIR registered few months back. I only commented on someone post and later it was deleted. I didn't make any such remark. It was basically a personal comment against the person who filed FIR. The police has asked me to appear before him on 27 october regarding this matter. What should I do now.

Received police notice under BNS 302 & IT Act 66B for an alleged Facebook comment. I never made such post; it was a personal comment later deleted. FIR is false. I seek fair investigation and protection from misuse of law. I’ll appear with my counsel on 27 Oct as directed.

Please do not panic. Since a notice has been issued by the police, it is advisable to appear on the given date, but make sure you go along with a lawyer. Carry a copy of the notice, screenshots of the post or comments, and any proof that you did not intend to make any threatening or defamatory remark. Cooperate with the investigation and politely clarify your side that it was only a personal comment and not meant to harm anyone. If there is any apprehension of arrest, you may also apply for anticipatory bail or further approach the High Court under Section 482 CrPC for quashing the FIR. Take proper legal assistance and do not ignore the notice.”

You must appear before the police on the mentioned date along with a written explanation and, preferably, through a lawyer. Since the allegations involve BNS 302 (which is a grave section relating to culpable homicide/murder) and Section 66B of the IT Act (related to misuse of computer data), you should not ignore the notice. However, from your facts, the alleged act seems to be a personal Facebook comment without any criminal intent — therefore, such sections appear misapplied. You should: 1. Engage a criminal lawyer immediately to accompany you and submit a short written representation stating that the comment was general, not threatening or defamatory, and has already been deleted. 2. Ask for a copy of the FIR and verify whether your name has been included and under what exact sections. 3. If there is misuse of penal provisions, your advocate can move an anticipatory bail application before the District Court or Sessions Court to prevent arrest. 4. Later, a petition under Section 482 CrPC can be filed before the High Court for quashing of FIR on grounds of absence of mens rea (intention) and abuse of process. Do not ignore the summons; cooperate politely with the investigation. Your presence with a lawyer and a calm written explanation will protect you from unnecessary harassment.
