If a criminal case is pending against you and the court has issued summons requiring you to be present in court then it is compulsory for you to be present in court on the date of hearing. In case you are not present in court on the date of hearing the court will first issue bailable warrant and the a non bailable warrant against you. lastly the court will declare the accused as a proclaimed offender and order attachment of the accused property in India. If abroad the accused will be immediately arrested upon arriving in India.

Hi, Given your peculiar circumstances and since this is the first time your presence has been required, an application under 205 CrPC seeking exemption from personal appearance must be filed on 31st August through counsel. Please feel free to contact me for assistance.

You must be having the copy of the complaint or the FIR that you must have registered. If yes, just keep it safe as it may be needed for further things. And for the coming 31st you need to hire an Indian Advocate and it’s better for you to attend at least the first hearing. Nowadays the court is also functioning on VC so you need not move anywhere. For more legal assistance I am just a call away.

You can appear through Video Conferencing in this case. Your counsel should mention in the court about the cross FIR thing in the court. Also, offences under compoundable sections can be settled between both the parties. Offences under non-compoundable sections can be quashed through High Court.
