Husband escaping arrest for fraud will wife be affected

17-Apr-2023 (In Criminal Law)
My friend is avoiding the arrest for an FIR lodged against him for fraud and forgery. He's staying away from his home to avoid the police. His bail at sessions court has been denied and now he's applying for bail at the high court. His wife is worried that police might show up at her workplace for questioning which might affect her job. Can you tell me if it is even legal for police to visit spouse's work place? Is it a possibility she should be prepared for? Once he applies for the bail at high court and wait for the hearing date, would the police be still be looking for him for the arrest? Please advice. Thanks.

Yes police can harrasse his wife to know his whereabouts or can go anywhere in the name of investigation. She may be called for investigation in the police station itself or police may direct her to be a witness

Hello, the bail will be depending on the crime, cognizable or non cognizable offence.
Under section 436 CRPC mentioned in what cases bail to be taken, sec 439 special power of high court regarding bail, there are exceptional and sufficient ground to release the accused on bail.
