Husband absconded and now filed divorce case 498 case already pending

05-Aug-2023 (In Criminal Law)
My Husband was absconding and then he filed a divorce petition. After this incident I have filed a F.I.R u/s 498A and a Domestic Violence case against him and his entire family towards all the wrong done by then.As i don't want to sabotage my marriage, I have filed for a restitution of conjugal right. If in case the decree is passed in my favor and my husband is not ready to comply with the courts decree? what is the probable remedy ? My In laws have filed for an R.C.S. against me to ensure that I do not enter the matrimonial house which is in their name.I am looking for an advocate based out at Thane with good experience on above case and with high English vocabulary.

Divorce happens with the mutual consent and if you don't wish to break away then you need not worry as law is always there to your rescue. Do you have children? If yes then you have a strong case and if no then also you need not worry. There are some capable advocates at Thane who will help you out in this.

You can filed for execution of decree on the Restitution Of conjugal Rights.
Court will pass immediate orders on the basis of the said order. No one can restrict you or restrain you from entering your matrimonial house. Even if any interim order is passed in RCS then it can be vacated on perusal of this Order.
I do practice in Thane court. You can approach me for your case.

First of all will make it very clear to you madam that even after getting decree of restitution if in law's are not ready to get u in, you cannot fulfill your wish on gunpoint. Best way to hit them monitoring by filling Civil Maintenance under Hindu adoption and maintenance Act and claim share in property. Also try to settle matter by making conversation with husband and not with in-laws.
