How to take back recovered stolen phone from police

30-Oct-2023 (In Criminal Law)
My phone was recovered by the police from the person who stole the phone , and the phone is in the possession of the police for 2 weeks already, can the police give back the phone to me on their own discretion without court orders ?or do i have to file for an application for release of the phone from the court ?nis it mandatory to file the application in the court for release of my phone? nI will be leaving the state in few days for a couple of months so it wont be possible to wait for the court orders after filing the application, since i dont know how long will it take.

hello you can file a zimma Petition for custody of your mobile phone. you will have to approach the CJM court and file the petition in the designated case under whose jurisdiction the said police station falls. it's a matter of a week to 10 days . it's a small case. it won't take long.
