Questions Answered by Advocate Suman Das

Advocate Suman Das answered
You can start by checking if a drain has been sanctioned by the Government or if it's a private drain that's being constructed. If it's a private drain then you will have to complain to your area municipality, your district collector's office and your area police station in case it is being constructed without following the due process of law and guidelines. Q: Seller asking for more money after 8 years

So we brought a land from a seller in 2016. We had it registered at the circle rate of that time. The seller had a registered power of attorney from his father which was used for the sale. The son is dead now. His father recently sent a notice asking for more money on the basis that his son was naive and we coerced his son into selling the property at a lower rate. We had recently started construction of our house. Can he get a stay order against the construction?

Advocate Suman Das answered
If there is reasonable ground and if he is successful in showing that his apprehensions are correct then he might get a stay order. Chances of getting a stay also increases with the Advocate they appoint. However there are remedies that you can avail to avoid such a tricky situation. Reach out to me for more information

Q: Forcefully demanding land by Aunt's son to Maternal Aunt

My grandfather gifted a plot of land to my aunt. but after both of their death her son i.e my cousin brother is demanding more land to my mother after my father's death. can he claim?

Advocate Suman Das answered
it depends on the type of land you inherited. if your father inherited the entire ancestral land and your aunt didn't then he can. if the land gifted to your aunt was inherited land (although it doesn't work that way most of the time) then he can't. if the land gifted was self acquired and your aunt didn't get any ancestral land then her son can. also the answer is based on the fact that your aunt is your father's own sister.

Q: Data entry job where they have signed a agreement

Hello , sir I have joined data entry work and after that they took my addhar and signature. File a cyber complaint against them first. tell the authorities that you have fallen victim to online fake job racket and now your sensitive information lays with such persons. tell them that you are also being blackmailed.

Q: Need advice to get custody of my two years old son.

31 y.o Female, currently unemployed. I have a two years old son. My husband is a defence personnel (army). I have been facing abuse from my husband both mental and physical since after a week of our marriage. It was a quick marriage,(within a month). Parents are not supporting me to come out of the marriage. My biggest fear is that I don't want to lose custody of my son.Since I am unemployed, court may not give me custody. I don't have enough proof, just some pics of bruise marks.Help.

Advocate Suman Das answered
get a check up done by a government registered doctor immediately and get the prescription. get your case registered in police station or file a domestic violence case in court and then if your husband files a divorce case then use the domestic violence case against him.
