Q: Suggestion on fully ownership of property given by my fathers will..

I resident of Kharupetia Town in Assam.We are three siblings in the family myself, my elder brother and elder sister. . My father made his last will a few years earlier and there he made me the sole owner of his immovable property after his death. Recently my father expired on 9th April 2024. Now I want to register the property in my name. My father's will was already registered earlier. What is the legal process now? My elder brother will not sign any NOC if needed.

you do not need any NOC from your brother. file a probate case and execute the will in the court. the court will summon your brother and your brother will challenge the will in court. if it's a registered will you don't have to worry about anything. either way you will have to file a probate case.kindly get in touch with me for further discussion.



Q: Is legal heir necessary for relinquishment deed

My wife's brother is threatening her to give up her share on her ancestral property after her father's death. He is asking her to sign a relinquishment deed. Thing is they don't have legal heir certificate or a succession certificate made. Do they require to make a legal heir certificate first? And if my wife signs the relinquishment deed can her brother sell the land or transfer without her further permission?

Hello I would like to know more details about your query. In brief I would like to summarise that you need to have a legal heir certificate for waris namjari or mutation. if your wife signs the relinquishment deed then she will not get her share and her brother can very well get the land in his name mutated and sell the property. kindly get in touch with me for further discussion.



Q: Regarding right to possession of land

So we have given half of our land to build a road in the village area but they don't want the land given by us instead they are demanding more land from us instead of telling our neighbours to also give their share of land for the road.Now they are threatening us to remove us from village if we don't listen to the villagers.

Q: Regarding Notary marriage if witness sign with wrong name

Sir i am little bit confused on matter .That day i witnessed a declaration of marriage between muslim boy and Christian girl Declared by Notary .Sir I signed with my nickname as witness .Is there chance for creation of any problem in future for being a witness

hellothank you for your query.With regards to the question posed by you, it is disheartening to know that notary marriage was done by a Government notary when such a marriage is not considered valid anywhere in the country. as long as the party does not register their marriage before the Registrar the said marriage is invalid. secondly, the signing of the nick name will invalidate you as a witness.



Q: Not recived of gratutie payment after termination of 5 years

I was terminated from my job with effect from 01/01/2019.my tenure of service almost 18 yeard.from september 2001 to march 2019.but i dont recived my gratutie payment yet now.my emloyer does not serve any notice in this issue till now.what should i do?
