How to prevent release for lack of evidence under s 302

Sir, belongs to hindu relision. On 09th jan 2017 my sister ( aged 24yr,12 stab injury) and her daughter (aged 2.5yr,45 stab injury) murdered by her husband.police have charged him with 'sec 302,304b,498a,34 of ipc but police failed to collect evidence of 302. so I am afraid that the accused might be released by court.but I have given evidence of 304b,498a. so please help me because I don't have any idea what do I do.
