How to get secure against the false case u/s 356 IPC

One lady register a false case of ipc 356 against me and my two friends and police arrests us although i get the bail on sameday but now what can i do because that lady can also give a false statement in civil court and we can suffer very much what should i do

File a criminal miscellaneous writ under article 226 of constitution of India for quashing of first information report before honble high court. But probability of quashing of first information report is very low.

Kindly send the copy of fir which will help me in giving you a specific reply and thereafter you have to do telephonic conversation for the solution. Still you need to file severalaffidavits of independent witnesses and they will state that you have done nothing and the incident was fake. Send those affidavits through ssp or senior Inspector of police station who will further pass those affidavits to Investigation Officer doing. Further if you were not present at the place of incident then you have to request the investigation officer to check your call details and get your correct location. If he denies to do Investigation then make a request to senior officials of police and further you can move an application to magistrate.

Hello in your matter lady filed in IPC 356 against you in these matters police has investigation whole matter afterthat he file chargesheet then you file an application under section 245 crpc for discharge so you consult any advocate on lawrato.com personally who belong or nearest in your city

If you think that lady can give false statements in civil court In this case you can give application in highcourt under saction 482 for quashing FIR and also file writ for the same and you can get relief

S. 356 of IPC is related with assault or criminal force in an attempt of theft....Now matter being sub judice before Ld. Court and being on regular trial, you all need to defend it effectively and efficiently with the help of some lawyer of repute. Although, you can also file S.482 petition before the Hon'ble High Court for quashing of criminal proceeding. Your query being incomplete, there could be another aspect of closing the case if the police investigation is still in process or chargesheet not being filed. However, in any case your defence should be effective but you need to bear the brunt for sometime to finally gain success.
