How to expedite FIR quashing process

18-Aug-2023 (In Criminal Law)
Hi, Me and my husband had filed for mutual divorce and First motion is done early this year and second motion in due next month. There is an FIR in my husband's name which as per the MOU, had to be quashed in the High Court by the guy's side but they have not filed the petition yet. It has been more than 6 months since the first motion but still they have not gone to High Court. My second motion date had been pushed to next month due to pending FIR. Is there any way the complainant of the FIR can do anything to expedite this FIR quashing process? Since the FIR is not quashed, my second motion would not happen until that is done. It has been delayed once and I do not want that it gets delayed again. Please advise what can I (complainant) do in such case to get the FIR quashed in High Court? Thanks, R

Since it's a mutual settlement, you have to for the sake of it pursue your husband for filling the quashing at high court on the basis of compromise. Only high court has power to quash a FIR so a petition is needed to be filed.
