How to defend a false 498A and 406 case in court?

GD evng sir..my wife filed a false 498a, 406, case in amboli police station in jogeshwari west..sir I am from Hyderabad.marriage took place in Hyderabad only..i belonged to muslim community..marriage took place 2.5 years ago..2 mnths back she told that she wants divorce...we were ready to give divorce..but she went to her mothers house in mumbai and lodge false 498a , 406 case..my all family members she mentioned in fir..my married sisters also included..all the allegations are false..plz guide I m unaware of mumbai law..

If false cases under sections 498a and 406 of the Indian Penal Code have been filed against you by your wife, you can defend your case and at the same time file a counter case against your wife. You can defend yourself and your family by taking the following measures:
 

  1. Collect Evidence and Documents: To prove that the accusation made against you and your family is false, you will have to collect all substantial evidence that can support your claim. These pieces of evidence can be-

  • Recordings of conversations (emails, chats, voicemails, call recordings, etc.).

  • Evidence to prove that you have neither demanded nor have taken any dowry.

  • Evidence proving that your wife moved out of the wedlock for no valid reason.
     

  1. File for quashing the FIR: You can file for quashing the false 498a FIR by the High Court. Usually, courts are reluctant in interfering with police procedure, however, if you have sufficient proof to prove your claim the court may quash the false FIR. The first let's take anticipatory bail for all those who have been named in fir then after the charge sheet or on basis of fir go for quashing of fir by giving writ on behalf of your married sister .
And file a criminal complaint under Sec 406 of IPC against her at your place .
