How to deal with case withdrawal and refilling

05-Jun-2023 (In Criminal Law)
I am from Hyd wife from Kol. Marriage, engagement and life after mrg was in hyd. She left me after 9 months n nvr returned. I filed divorce under cruelty. she filed maintenance and 498a (by taking court cognizance) cases in kol where I have never been. If she withdraws 498a cse, can she refile? Can I fight it that theres no jurisdiction for Kol criminal court?

Yes, even if she withdraws 498a, she can file again. You cannot fight on Jurisdiction. You have to attend the court at Kol. My advice is to pay some compensation and get the matter compromise and settle. Pay the amount (DD) to the Judge only and not to the party. At the time of compromise write that the matter is settled, she will not claim any amounts in future and she drops 498a and maintenance case and she will not file any other cases relating to the marraige etc.
