How to deal with 304II , 185 MVI

My car had hit a road side hut in which 2 persons who are sleeping are dead. The sections they put on me are 304II, 337, 185 MVI. How can i get out from the case

vehicle failure , poor visibility, overtaking vehicles turning in towards your car etc are good defense's . if the passengers travelling in the car are also injured and driver of hospitalized for more than 48 hours, these can be good grounds to defend yourself
