Dear Client,
No act is illegal if it's not prohibited by law. Any citizen earning money legally, via legal modes is free to earn and nobody can stop him.

During IT return, if query are raised, you have to show source of your income and topic ends there.

As question is hypothetical, nothing much can be said. It would be better if you ask straight and clear question to guide you in better way.

An IAS officer can not be involved in any business directly or indirectly as the service rules clearly prohibit it.

And even if someone tries to setup something on his/her own name or indirectly through someone else than it can be identified easily, as the office might use the power for personal benefits. And any such rank officer would not want to stain the career with such blames.
