House owner absconds with lease money

I have been living in a flat since 2017 September. Last October I came to know that my house owner failed to pay home loan (currently on the flat which I live) is not paid and bank people pasted notice for auction. When I contacted the owner ,he is not picking up phone and when reached the place where he lived before, we found he is abconded. Bank people asked us to vacate and police is not taking up the complaint and asked to deal with court. His phone number is still active but not picking up.He is an ex punjab national bank manager.
This kind of case has become prevalent nowadays. The option is to file a civil suit for recovery of money, but the result is doubtful with the owner absconding. You can file a criminal case for cheating because the owner knew that the house was under loan and he rented it without the bank's permission.

In this case, When your landlord has delayed the repayments for 90 days, landlord loan becomes a Non-Performing Asset (NPA). Banks treat any loan as NPA only when they had failed to make a payment successively for three months. So, banks don't immediately seize the assets of borrowers after default.
