After the enactment of the new criminal laws, you may directly lodge an FIR under Section 69 (read it online for your guidance) of the Bharatiya Nyaya Sanhita for sexual intercourse obtained on a false promise of marriage. This is a non-bailable offence. Preserve all chats and evidence. For proper legal guidance on the next steps, you may consider seeking professional advice.

Sexual relations obtained on a false promise of marriage can constitute a criminal offence if the promise was dishonest from the beginning and induced consent. A mere failure to marry is insufficient; it must be shown that there was no genuine intention to marry at the time the promise was made.

Under the Bharatiya Nyaya Sanhita (BNS), sexual intercourse based on a false promise to marry is a criminal offense. You can file an FIR at the nearest police station to initiate legal action as per the concerned provisions of law.

You may file a criminal complaint if the consent for physical relationship was obtained on a false promise of marriage. If it can be shown that from the beginning he never intended to marry you and induced you only for sexual relations, it may attract offences under Section 376 IPC (rape on false promise of marriage) and cheating. First, lodge a written complaint at the local police station or Women’s Cell with all facts, dates, messages, chats, and other evidence. If police do not register FIR, you may approach the Magistrate under Section 156(3) CrPC. Consult a local advocate to assess evidence and proceed properly.
