Guidance for expediting defamation case proceedings

07-May-2026 (In Criminal Law)
Since Oct'22, I’ve faced a summary criminal defamation case filed by my maternal uncle's wife, I learned of it in Feb'23. The case status is"Unready board". The complainant was frequently absent on the dates. My old lawyer didn't seek for quashing, only filed bail at the 1st hearing. My new lawyer submitted application for D.I.D but complainant and her lawyer were present today for issuing an arrest warrant against me. I would appreciate legal guidance.

Contact for more information In a private criminal defamation complaint, arrest warrant is not issued mechanically if the accused is appearing or represented through advocate. If you have already obtained bail and are attending proceedings, your advocate may oppose warrant and seek exemption/personal appearance relief. “Unready board” usually means the matter is not ready for effective hearing. Repeated absence of complainant can also be brought on record. Your advocate may consider filing discharge/quashing petition depending on facts, limitation, jurisdiction and contents of alleged defamatory statements. Keep all court dates attended properly and avoid remaining absent without exemption application. Obtain certified copies of complaint, verification and orders for proper legal strategy.

In a summary defamation case, warrant is not automatic. Your lawyer may seek recall/cancellation of warrant, exemption from appearance, discharge/quashing and oppose coercive steps citing delay and complainant’s absence.

If warrant plea is moved, seek anticipatory bail/recall immediately through your lawyer. In summary defamation cases, repeated absence of complainant can support discharge/quashing. Attend dates as per the concerned provisions of law.
