Guidance for dismissal/quashing of defamation case.

15-Apr-2026 (In Criminal Law)
Since Oct 2022, I’ve faced a criminal defamation case filed by my maternal uncle's wife. I learned of it in Feb 2023. The case status is still "unready board". The complainant rarely appears for hearings. My previous lawyer didn't seek for quashing the case. my new lawyer will apply for dismissal in default at the next hearing. As a final year student, this case hinders my job prospects. I really need urgent legal remedies to quash/dismiss and expedite this matter asap.

You have multiple remedies in law. First, your advocate is right to apply for dismissal in default under Section 256 CrPC, if the complainant remains absent. The Magistrate can dismiss the complaint and acquit you. Secondly, you may file a quashing petition before the High Court under Section 482 CrPC if the complaint is false, vague, or lacks ingredients of defamation under Section 499 IPC. This is an effective remedy to end the case at an early stage. You can also file an application for exemption from personal appearance under Section 205 CrPC to avoid regular court visits. Further, you may request the trial court for speedy disposal, citing delay and prejudice to your career. Courts generally consider such grounds. Ensure your advocate places on record the repeated absence of the complainant and seeks strict action. Keep all documents ready and attend the next date properly.

Seek dismissal under Sec. 256 CrPC for complainant’s absence. Also file for quashing under Sec. 482 CrPC citing delay/abuse of process, and request speedy trial. Court can close long-pending inactive cases.

instead of expediting the matter and going through a long process, ask your lawyer to file a taken on board application and mention that the complainant is not appearing in the matter and seek for dismissal.

You can seek dismissal of the case for non prosecution by the complainant or you can file an application seeking quashing of FIR and the proceedings arising thereof before the Hon'ble High Court u/s 482 of CrPC.

Seeking dismissal in default under Sec 256 CrPC due to the complainant's continuous absence is the correct immediate step. For a faster, permanent remedy, you should file a quashing petition in the High Court under Section 482 CrPC. Ensure you annex proof of your final-year student status and job prospects to request an expedited hearing and stay on the lower court proceedings.
