Got summons as I didn't attend the court dates i am the complainant

M Hindu (female )from Mumbai I have launched complaint of Sec 376 n 420 , in 2012 ,attended few hearings for 1year then that person got bail ,then after I stopped attending the courts dates , now reaceived a sumance , I have to go n attend the hearing tomorrow. I will go there but I m not in my state of mind n don't have patience to take this case ahead want to stop here , plz guide me what I can do now ? What I should say tomorrow so that I can come out of all this . Please reply asap.

Respected Client , Please remember that you had launched a complaint and as 376 is a serious offense you will have to attend the trial, they might have called you for your examination in chief and cross examination as you are the complainant. please contact the (public prosecutor/ Government lawyer ) who is from your side and he will definitely guide you further as to your state of mind you can maybe take the next date tomorrow. please talk to your public prosecutor for further assistance.

The matter might be kept for evidence, as you are the complaint you would have to attend the hearing as evidence Cannot be taken in your absence and it would depend on number of witnesses as to how many times you have to attend the court, you can request the court to expedite evidence so that u can be free thereafter..

Dear client if u donot attain the court proceeding then court will dismiss ur case and accused will get aquitted. Then accused may file case of defamation against u and may ask huge amount as compensation. For any legal help call me

Hello Ma'm,

If you have received summons from the Court that means the case is on a Trial now. As of now you cannot withdraw the Case. The only way you can stop it is by refusing to give any evidence but then that will make you look bad in law .

I would advise you that you attend the court and take an adjournment and then consult with a Advocate in details for what is to be done.
