Girlfriend Blackmailing for False Rape Case for Marriage

27-Aug-2023 (In Criminal Law)
Had 4 years of love relationship. Both of us wanted to marry & hence introduced to parents in April 2018.Later had consensual sex during Oct 2018 not on any pretext of marriage promise.Relationship turned sour from 2019 because of overpossesiveness & trust issues. Had numerous fights as she started stalking & threatening.Hence I informed I am not going to continue the relationship. She did not listen & later in Nov 2019 she wanted to have sex & started sending messages for this favour.I avoided her & told her no as I am not ready for the relationship. But she asked me to meet for 10 mins and came to my room & started hugging and kissing.I resisted & stopped her but later gave in.We had more fights in 2020 & we decided to break up.Hence I informed her brother regarding this. But later she informed her parents regarding our intimacy & they threatened me to marry.Because of this threat I agreed to marry after 6 months. But I seriously don't want to marry under force as this has become abusive

Consensual sex is not amounts to rape. Keep those messages in your safe custody and also try to collect as much evidence as you can which could help you in court. Just relax no need to worry. and does you girlfriend is below the age of 18yrs at time of having sex?? if not then you no need to worry. Just collect the vital evidence and keep it with you.

Look, if your girlfriend lodged FIR agianst you for rape case, then the police personnel will start collecting evidence against you. In my opinion, those text can be a evidence against you as she blamed you that she cohabit with you as you promised to marry her and with that condition she gave consent to cohabit. Though this is too premature stage to guess something. I would advise you to stay calm & keep patience. Try to solve mutually this hectic problem and please keep monitoring on online FIR. Thank you.

You need to approach the local police authority and explain the whole matter to them and file a formal complaint against the said lady. The texts she send asking to have sex will be very useful here, for the purpose of establishing that the sex was consensual.
