FIR quashing is done by filing a petition under Section 482 CrPC before the High Court on grounds like false FIR, civil dispute or settlement. Court hears parties and may quash FIR. Under BNS regime, FIR quashing is still done under Section 528 of BNSS, 2023 (earlier Section 482 CrPC), invoking inherent powers of the High Court to prevent abuse of process.

You have to draft the petition for quashing with lawyers by providing details of case and documents, then file your case at respective high court and schedule for hearing by requesting court. After arguments of both sides you matter will be over

Common Grounds 1. False or exaggerated allegations 2. No specific role mentioned against accused 3. General allegations against in-laws 4. Settlement / compromise between husband and wife 5. Divorce by mutual consent 6. FIR filed after long delay 7. No medical or independent evidence 8. Case filed only to harass or take revenge 9. Allegations are civil in nature, not criminal Even though 498A is non-compoundable, High Court can quash on settlement basis.

Quashing of the 498A chargesheet is possible only before the Hon’ble High Court by filing a petition under its inherent powers. On your behalf, we will draft and file this petition, place all supporting documents (chats, settlement, absence of medical/independent evidence etc.), and request the Court to quash the FIR and chargesheet on grounds that the allegations are false, vague, or purely matrimonial/ civil in nature and that continuing the case would amount to misuse of criminal law. If the Court is satisfied that no prima facie offence is made out or that the matter stands amicably settled, it can pass an order quashing the proceedings against you.

After filing of a chargesheet under Section 498A IPC, the accused can approach the High Court under Section 482 CrPC for quashing. The process involves filing a Criminal Writ Petition or Criminal Application seeking quashing of the FIR, chargesheet and proceedings on grounds such as false implication, absence of specific allegations, matrimonial dispute being purely civil in nature, settlement between parties, or abuse of process of law. The High Court examines whether prima facie ingredients of the offence are made out and may quash the proceedings to prevent miscarriage of justice.
