Freezing Bank account before issuing 41 notice

A person in a commercial transactions surpassing facts of agreement did 156(3) and after allowing of the same by court police registered FIR on complain under lpc 420,406 and 120B IPC. Further before issuing 41Notice freeze the Bank account of the opposite party. Is the action of police justified.police freeze the Bank account under 120crpc.

it depends upon the facts and circumstances of the case whether the police authority is justified to freeze the bank account but the owner of the bank account is always at liberty to challenge the action of the police before appropreate forums mainly before high court. you may approch the high court with a writ petition against action taken by the police.
