Fraud of a gold chain by an intermediator. What should we do now?

14-Aug-2023 (In Criminal Law)
Let’s say A & B are college friends. B wants to get a gold chain made. A goes to C to get the chain. B pays full amount to C and chain is ready. A asks for the chain, C confirms from B before handing over the chain to A. C gave the chain to A at A’s house with all his family present . After that A is not responding any calls or texts from both B & C and even A’s mother is denying any transaction being made. Even family of A is not getting involved. What should B & C do now?

This makes A and his family members present during the transaction liable to be punished under Section 406 IPC and Section 34 and Section 120B of Indian Penal Code. In order to know how to proceed against them, you may consult me in that regard.

rights of parties depends on what documents and evidence are available. if any evidence/proof of delivery of gold chain to A are available, then A can be made liable to return the chain to rightful owner.

A hypothetical question herein so the answer will be that Gold Chain can not be bought or sold without documentary proof. if B can show from th documents that a gold chain was there then in the eyes of law it will be acceptable otherwise anyone can say whatever they wish. for ex X can say that he has lent 1 cr to Y and without any documentary proof there is no evidence. so the can be rejected
