Fradulent transfer of Shares from my Demat a/c to other demat A/C

25-Jul-2023 (In Criminal Law)
My Mother had demat a/c opened in 2000 by my father which my father didnt informed anyone of in our family. My father passed away in 2003. There were some shares in my moms demat ac. Few days back we got hold of an old document file of my father which was lost. This file had all details of demat ac and no of shares held till 2003. Since we were not at all aware about this ac, we checked the details of demat with broker. He mentioned that the Ac had been closed in 2008 and all shares have been transfered. After checking details, we learnt that a known colleague of my father had fraduly got documents signed form my mom and had transferred all her shares into his demat ac and got her ac closed without her consent by means misguiding her and getting documents signed in fradulent manner. The total worth of those shares in current time is more than 25 lakhs. As we have discovered this just aa few days back, I want to take a legal action . What legal course of action can be taken now?

Hi, Considering your query, a complaint for cheating may be filed with the police against the errant party. Further, if you have legitimate proof and proper grounds for justifying delay in approaching the court, a suit may be filed seeking a declaration to the effect of voiding the transfer as the documents had been signed under misrepresentation and fraud. Please feel free to contact me for any further assistance.

this is a case of cheating and you must take immediate action as already a lot of time has lapsed. You can file complaint a complaint with the nearest police station. if police does not take action file a complaint with the court. besides criminal complaint you can also file civil case for recovery of shares and damages.

first of all, you should file a criminal complaint against that person, who is said to be friend of your father as he has committed criminal breach of trust, fraud with your mother. It is to be seen as to for what purpose he obtained signature if your mother. In this matter investigation is needed ti find out truth.

If he is not listening to you then you can send him a legal notice and in that notice you can write either refund my money back along with compensation or face legal action. And if want to go legal then you can always forward a written complaint to the police station of your area. For more legal assistance I am just a call away.
