FIR order by court for Dacoity

16-Oct-2026 (In Criminal Law)
I recently posted about False 173(4) for dacoity against us as a counter blast https://lawrato.com/criminal-legal-advice/Other-party-has-applied-for-a-dacoity-case-after-our-FIR-271642 Today we got to know that judge ordered a FIR. Their was no evidence produced. Just a sworn affidavit interestingly was enough for judge to order FIR. What should be our next step? Considering this judge might not be very clean.

As per the facts shared, kindly provide a certified copy of the Magistrate’s order, the complaint along with the sworn affidavit, and copies of the relevant FIRs and supporting documents. After examining the complete record, I can advise you on the appropriate legal remedies and further course of action, including the possibility of challenging the order before the competent court, if legally maintainable.

The reasons you’ve stated fall squarely under Bhajan lal case, whose benefit can be availed to you and the said FIR can be quashed / cancelled upon proper representation and pairvi before the court, under Section 482 CrPC / 528 BNSS.

If you are sure that the FIR has no substantial facts or evidence at all, then obviously you can go for quashing in the High Court under Section 528 of BNSS 2023. Or in the later stage, you can go for a discharge application in the appellate authority or court.
