Q: Vasiyat banvaney se sambandhit
Vasiyat banate samay haath se likha hona zaroori hai ya type karvake bhi de sakte hain
Advocate Manish Nigam answered
type kara kar bhi de sakte hain Jaruri yah hai ki do Indian witness zaroor hona chahiye,
Q: FIR order by court for Dacoity
I recently posted about False 173(4) for dacoity against us as a counter blast https://lawrato.com/criminal-legal-advice/Other-party-has-applied-for-a-dacoity-case-after-our-FIR-271642 Today we got to know that judge ordered a FIR. Their was no evidence produced. Just a sworn affidavit interestingly was enough for judge to order FIR. What should be our next step? Considering this judge might not be very clean.
Advocate Manish Nigam answered
If you are sure that the FIR has no substantial facts or evidence at all, then obviously you can go for quashing in the High Court under Section 528 of BNSS 2023. Or in the later stage, you can go for a discharge application in the appellate authority or court.

Crl.M.P. of 2026 filed under Section 319 Cr.P.C. remains pending for respondent-side arguments/enquiry since may 2026 , which is repeatedly adjourned at the request of the respondent side, while the main C.C. case of 2021 has itself been pending since the year 2021, whether the proceedings can be permitted to remain indefinitely pending by repeated adjournments, or filing 309 crpc in next hearing for expeditious disposal and in accordance with Section 309 Cr.P.C, to what will judge do, opinions
Advocate Manish Nigam answered
You need to make submissions to the Honorable Court for imposing costs on the opposite party for unnecessarily delaying the legal process, and you have to fight your case with a little more aggression. Also, it is very important that this process under Section 319 CrPC is very much required to decide the fate of your original case.
Q: Is Anticipatory Bail Necessary While Going Quashing Of FIR
I just want to ask that the status of my case is such that charge sheet has been submitted in the march month of 2026 and the edvocate submitted anticipatory bail right after a month of submission of the chart sheet which got rejected in the sixth month of this year now I am planning to go for the quashing what should be my strategy with my anticipatory bail and my parents anticipatory bail should I seek or not?
Advocate Manish Nigam answered
In which sections was the FIR registered, and what are the sections which are mentioned in the charge sheet? if it's a matrimonial case, then write down the sections, and we'll update you accordingly, without knowing the actual allegation, it is very difficult to tell you the fate of the case.
