Fir for visiting a dance bar did not indulge in any obscene behavior

08-Apr-2025 (In Criminal Law)
Hi, a few days back my friend and I visited a dance bar. We did not interact with any of the girls there. We didnot dance nor threw cash at the ladies. The place was raided by the police at 11 45 pm and we were taken to the police station. Both of us were handed a notice saying we were being charged under section 296 of the bns. I downloaded a copy of the fir and saw that both of us have been added to the list of accused along with a few ladies and staff. Wil this affect passport application

It is a minor bailable case section 296 of BNS chargesheet or Yogan arrested or your name is only referred in FI you can still apply for passport but you must disclose the pending case in your application of charging file or a fire mentions you then submit an action I self declaration of criminal record flying under Tatkal if the case is pending passport office may ask for court order NOC permitting issuance of passport or you may need to wait for discharge acquittal before proceeding

Section 296 of the Bharatiya Nyaya Sanhita (BNS) deals with obscene acts and songs. It prohibits acts that are obscene, or singing, reciting, or uttering obscene songs or words, in or near any public place. A person violating this section can be punished with imprisonment for three months, a fine of 1,000 rupees, or both. Well, as this is a Cognizable and Bailable Offence, you can get Bail as a matter of tight, but you either need to get a Clean Chit or get this FIR quashed, otherwise, it may impact your Application to get Passport!
