FIR Filing Criminal Complaint for a Civil Matter

04-Jul-2026 (In Criminal Law)
If a FIR has been filed by a person against someone for a civil matter, painted as criminal matter. The complainant has threatened to destroy lives of accused and people related to accused, a few days before filing FIR and some evidence is there that the accused were involved with the complainant in a civil/personal matter and this has been only done to escalate the issue out of ego. During the course of these proceedings the complainant tries to threaten the accused multiple times indirectly.

You can challenge the FIR in the relevant High Court under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) or Section 482 of the old CrPC for abuse of process. You should also immediately file a police complaint or initiate court proceedings regarding the complainant's ongoing threats

Hi. A FIR quashing case can be filed before the High Court if it's a criminal dispute which has been painted as a criminal matter. The facts and circumstances of the case will have to be analysed so please get in touch for further discussion.
