Aapke bataye gaye tathyon ke anusar, aapki wife ka ilaaj meningitis/encephalitis aur seizure ke liye hospital mein chal raha tha aur lagbhag 7 din ICU mein treatment ke baad unki mrityu ho gayi. Hospital death summary mein bhi cardiac arrest ko death ka immediate cause bataya gaya hai. Post-mortem report mein myocardial infarction (heart attack) ko mrityu ka karan darshaya gaya hai. Saath hi, kuch ante-mortem injuries jaise contusions aur abrasion ka ullekh hai, jo haathon ya sharir ke anya hisson par paayi gayi hain. FIR mein BNS ki Dhara 80(2), 85, 61, 115(2) tatha Dowry Prohibition Act ki Dhara 3/4 lagayi gayi hain. Lekin keval injuries mil jaana ya post-mortem mein contusion ka zikr hona apne aap mein dahej mrityu ya cruelty ko siddh nahi karta. Prosecution ko yeh sabit karna hoga ki mrityu se thode samay pehle (soon before death) dahej ki maang ya uske sambandh mein utpeedan hua tha. Aapke anusar shaadi ko 4 saal ho chuke the aur pehle kabhi koi complaint ya report nahi hui. Yeh tathya aapke paksh mein mahatvapurn ho sakta hai, yadyapi akela nirnayak nahi hai. Aap turant post-mortem report, treatment records, ICU papers, death summary, investigation papers aur call/message records surakshit rakhein. Agar giraftari ki ashanka ho to anticipatory bail ya anya uchit kanooni upchar ke liye kisi anubhavi criminal lawyer se sampark karein. Antim nirnay sabooton, gawahon aur poori investigation ke aadhar par hi hoga.

Fir to apke against koi bhi case nahi banega qki Death sirf Medical or Health issue ke wajah se hua hai. apki Sadi ko agar 7 year ho jata to dowry death ka case nahi banta fir bhi apke pas medical record hai jo ki har case me apka bachav karega

अगर doctor se opinion के बाद आपको लगता है ke इलाज me लापरवाही hui hai to आप consumer forum me compensation ka case डाल सकते hai ya criminal complaint भी magistrate ke yaha डाल सकते hai.

For proper legal advice, you may call or visit my office with all the relevant documents (FIR, Post-mortem Report, Hospital Records, Death Summary, etc.) so that the matter can be examined in detail before giving a final legal opinion. Response: Based on the facts shared by you, no adverse conclusion can be drawn merely because the post-mortem report mentions three contusions and one abrasion. Such injuries may arise due to accidental impact, shifting of the patient, medical procedures, or life-saving resuscitation efforts, unless the medical expert specifically opines that they were caused by an assault. From your query, it appears that your wife was admitted for treatment of meningitis, encephalitis and seizures, remained in the ICU for seven days, and both the hospital records and death summary mention cardiac arrest as the immediate cause of death. The post-mortem report also records myocardial infarction as the cause of death. These medical records are important pieces of evidence and cannot be ignored. You have also stated that your marriage was about four years old and that there had never been any complaint of dowry demand, cruelty or domestic violence prior to this incident. If this is supported by the available record, it is a relevant circumstance that may be considered during the investigation and trial. However, the final outcome of the case will depend on the complete evidence, including the post-mortem report, medical records, expert medical opinion, witness statements and the material collected during investigation. Therefore, preserve all hospital documents and cooperate with the investigating agency. A detailed legal opinion can only be given after examining all the relevant documents. You are welcome to meet in person with the complete case papers for proper legal advice and an appropriate defence strategy.
