From the facts stated by you, if the respondents have already filed a detailed counter dealing with the contents of the revised petition and you have thereafter filed a rejoinder, their subsequent plea that they never received the revised petition may not appear consistent with the record. You may draw the Court's attention to the counter affidavit, rejoinder and the order sheet submit that the respondents have already participated in the proceedings on merits. If their stand is only to delay the matter, you may request the Court to reject such objection and proceed with the case. However, a proper legal opinion can be given only after examining the complete case record, pleadings and court orders. N badle me party ko cheque aur stamp par likhwa ke diya tha jisko paise dilwaye the usse n usme bas witness me sign kiya hai guatantee kuch nai di hai. Ab woh aadmi kaam nai kara paa raha hai n paise bhi nai de raha hai toh party case karne ke liye keh ri hai n usme papa ke naam bhi dalwaane ke liye keh rahe hain.kya karun?

From the facts stated by you, merely signing as a witness does not automatically make your father legally liable. If he neither received any money nor stood as a guarantor, his liability will depend upon the terms of the documents and the nature of the transaction. If the payment was made directly between the parties and your father only signed as a witness, he has a valid legal defence. However, it is not possible to give a final opinion without examining the cheque, stamp paper and all other relevant documents.
