FIR against me settled with police asking to be present for filing

There is an FIR under IPC 507 against me for which I have given a statement to the police. I stay in another city and now they are calling me again as Police claims my presence is mandatory for filing a chargesheet.

Till the bail is granted by the magistrate, some courts insist on the presence of the accused for filing of charge sheet also. You may appear once and apply for bail. Furthermore, you may apply for permanent exemption in terms of a Supreme Court judgment due to the fact that you live in another city. You will have to tell me your current state for enabling me to address your query in a better manner as in states like UP, a direction has been given by the Allahabad HC that accused must be present at the time of filing of charge sheet. Hi,

Are you on bail or not. it is true during the course of investigation you have to cooperate with the police otherwise it may lead to cancelation of your bail. so I hope you have got the answer. if you are on bail it is also condition of the bail.

Your presence Is not mandatory on the date on which the chargesheet is presented . But then on that day a summon shall
Be issued against you directing you to appear before the concerned court . On that day you need to appear in person or through a competent lawyer who justifies your absence properly . Take proper legal advise prior to proceeding otherwise non bailable warrants might be issued against you .
