Greetings of the day If the application is urgent, then you should jot wait for the NDOH. It is standard practice to serve a copy of your application to the Prosecutor as well as the other party. I would suggest that send the application via speed post even if the other party is at same location as by it you will have the proof of service (slip of post) Thank You

An application in a pending criminal case can be filed anytime at the court registry/filling counter; there's no need to wait for the next date of hearing. However, the court may take it up on the listed date unless urgency is shown. As for service, if the opposite party or public prosecutor is at the same location, a copy can be served by hand with acknowledgment. Otherwise, registered post or email (if permitted) is used. Always retain proof of service. Standard practice is to file early and serve immediately for fairness and record.

Normally the applications can be filed anytime before the concerned court that can be taken up on the date fixed by the court. And as far as the opposite party is concerned it can always be taken by them by applying for the certified copy of the same.

You can file an application between the matter and hearing. For filing you can go to the filing counter of the court and simultaneously give a copy of the application to the opposite party. The common practice is to hand over the physical copy to the concerned parties.
