filing a criminal case in magistrate court or high court

I purchased a CMDA plot in Thiruvallur Dist in Oct 2004 from a Power of attorney authorised by Principal owner is ICI,ltd.After one to Two months of purchase,there was proposal of HT tower and lines over the plot..I approached the seller assured no laying of HT lines which stayed ..He kept assured alternative site will be allotted . But so far nothing has been done.He has cheated by selling the plot which was having encumbrance and the land was acquired by EB.Legal notice issued and police complaint in CCP given.Now kindly advice criminal case to be filed in magistrate or High court.

The best place to sue him is Consumer court, There is no point in going to High court now as the jurisdiction is only consumer court. Filing of criminal case will yield little result, as the said offences are not made out, if i am right it should have been under 120B, 417, 420 and 506(1). of indian penal code.
