Falsely imposed 378 case got bail but no chargesheet made yet

If accused wrongly charged under 378 by concern police station with and free by taking regular bail form court. But till date charge sheet not filed by investigeting authority ( 90 days lapse) and in between if accused can proceed before higher investigating authority for against the main accused. and Higher authority if taken the statement of the other person then that statement may be considered in court before trial while taking the statement of the accused before the court.
