False case of fraud and cheating

28-Aug-2023 (In Criminal Law)
My husband has been charged with sec 420 and 406 of IPC. He is in police custody from 24th Aug. He took a car on lease from a person for which he made agreement pprs and he gave dat car to another person to drive and he told abt this to the owner of the car. Now the person to whom he gave the car to drive has disappeared along with the car. He is absconding. The owner of the car had called him on 24th Aug to the police stn to give his statement but the owner had actually filed a case against him. He shd be charged of only sec 406 but he is also charged of sec 420. The police was nt ready to put the charge as it was nt required but the owner contacted some corporator nd he pressurised the police to charge my husband with section 420 also which was nt required at all. My husband appeared in the court 2day ie,28th Aug nd MCR was issued. So bail applicatn was made. Will he get bail on Mon i.e 30th, will he be released and hw can the charges be removed? Our financial condn is very bad.

Sorry to know about your situation. Once the police file their say to your bail application, your counsel will argue the matter and it is likely that the bail will be granted. If declined, you will have to approach sessions Court for bail which will take at least a week's time to decide....

Dear queriest, yes you can get the bail, as you have to argue while putting up the bail application accordingly and to get out of this charges you have to file discharge application before the court before police files their charge sheet. for more information in detail kindly contact me.
