My wife has filed a false attempt to murder case (307 ipc) and (498A ipc) against me and all of my family members. She has told in FIR that that i tried to strangulate her using a dupatta ,she escaped and made a phone call using a passerby mobile and called for help. I know this whole story i false , How can i prove my and my family innocence. I got married 3 months ago and my wife and her family is very greedy. She went peacefully to her home along with her parents. She messaged me after reaching home also. I have that message in whatsapp. She called me that night when she went along with her parents. Can the police retrieve that phone records . More-ever she has filed this false FIR after 12 days , so i feel this is with a intent to harass and trouble us and extort money and she has taken help of local politicians to register this complaint .
Firstly you should apply for anticipatory bail for you and your family so that police will not arrest anyone. Secondly you should go for High Court under 482 of CrPC for quashing of FIR and complaint. If the HC is of the view that the complaint is false then it will quash.

Such cases are normal for police and Courts. You may take a option to approach High Court by filing 482 Cr.P.C petition for quashing and staying the same. If charge sheet is file discharge application under Section 239 of Cr.P.C. If evidence commenced then get prepare the questions to be asked to witnesses by an experienced advocate.
