False accusations u/s 376 and 417

My brother is accused by his girlfriend with IPC 376 and 417.The case is totally falsified. I have lots of proof in Instagram/fb/watsapp chats of the girl, numerous voice messages which will prove that the accusation is totally false.The girl has done that out of anger and rage and she is now telling only to my bro that she will withdraw the case if he seeks sorry. We don't want my brothe to get married with her. If to come out of jail my brother says sorry, is it possible to withdraw the case?
