Fake complaints and FIR and clarification about them.

28-Apr-2023 (In Criminal Law)
Sir, I want to clarify that I am a student. Some people try to make fake FIR against us so that we do not a good job. I am a CA student and someone does with me the same. Someone filed a complaint against me in the police station. I was called by a police officer and after giving some clarifications, he asked me to write the letter saying that you feel sorry for that and he then leaves me. But from that date, some threat creates into my mind. Please clarify: a. Unless and until it is proved by the court that we are guilty, nothing can happen to us. b. The complaint which was lodged against me and after writing the sorry letter will have no effect on my career. I will be very thankful to you for your help

to answer your question (a), you cannot be convicted or sentenced before a trial, but the police can of course call you for interogation and on the pretext of not being satisfied with your answers/ cooperation, also make an arrest for further interrogation, if the offence is cognizable. to answer your query (b), some companies want to know whether any criminal case is pending against you and such disclosure generally has an adverse effect. the legal remedies available to you are: (a) filing a petition for anticipatory bail (b) filing a petition for quashing the criminal case (c) filing a criminal case against the person who has filed the false criminal case against you.
