Excessive high bail bond conditions

Incase of multiple FIRs bails have been granted in all but unable to furnish excessively high bail bond amounts leading to prolonged incarceration.

Where bail has been granted in all FIRs, continued incarceration solely due to inability to furnish excessive bail bonds or sureties may violate the right to personal liberty. The accused can seek modification/reduction of bail conditions, as bail terms should be reasonable and not so onerous as to defeat the grant of bail itself.
Section 440 CrPC / Section 480 BNSS 2023 — Court has power to reduce the amount of bond. A formal application can be filed before the concerned court seeking reduction of surety amount.
Section 439 CrPC / Section 483 BNSS 2023 — Application before Sessions Court or High Court for modification of bail conditions including reduction of bail bond amount.
