Does layman have a right to argue in court of law in state vs others
14-Oct-2023 (In Criminal Law)
I had filed a criminal case u/s 451 against a person . which was registered as state vs other. Now A.P.P. is handling my case in court on behalf of state. I have also appointed a private advocate for my case. Now i myself want to argue and present the facts in court. But judge of CJM court said to me that only APP can bring the facts to court and only he is entitled to argue in this case, as this is a state vs others case . And i m party from state side , so only APP has right to present the case. My question is that I m the person who knows every minute detail of case ,then why i m not allowed to argue or present the facts before court.
Sir i read your question.. and accordind to crpc if u are a party in a case. And u want to present some documentry evidence and some truth. U must have to get present ur documentry evidence by a.p.p till charge stage. And after charge stage u want to present some additional evidence. It can only presenting by investigation officer according to 173(8) crpc.and ur last question that why u not allowed to argue in court becz u are complaint and u are a party of state. U can not argue in court becz court has appoint a public prosecution for state and u. U can present ur truth and evidence in ur evidence in evidence stage.
