Does a pending case effect joining a govt job

 I have been recruited in Central Govt. in 2013 and an FIR (IPC 420) had been filed against me in 2014 due to some property dispute. I have never been called for any enquiry from then. I have not informed to my deptt. so far. I am not main accused in this case but my name is in FIR. My case has not been admitted in the Court yet. Should I inform my department about it. I am about to switch my job in another central govt. deptt. I will have to produce "whether any case is pending against me" in attestation form. I am very afraid of losing my new obtained job. what should i do??

first of all you need to check the status of your FIR, is the case is pending and at what stage it is so that you can get to know the actual picture of the case . so far you are not called even once. With the FIR DEtails you can check the status of the case . you should inform the new department about the case.. but before that kindly verify the details of the pending case. it might happen that the case is compromised or some other fact would be there.

Please go through following judgement of Kolkata HC. Kamal Kumar Narottam Dash Pareks vs Superindentents. It makes following statement " The proceedings that reaches the Court in course of investigation cannot be held to be a "proceeding pending in a Court." Such proceedings remain still at the stage of investigation, and gets transformed into a "proceeding pending in a Court" only, and if, cognizance thereof is taken by the Court.
If the attestation form states FIR, etc, then please mark yes, whereas a registration of an FIR does not mean a case is pending against you.
