Disposal rate in Karnataka High court and Supreme Court
07-Jan-2023 (In Criminal Law)
If a judgement is passed by session court (3 years) for 307 and 326, and I appeal to high court in Karnataka how long can I expect it to continue till final judgement passed from HC (at least and at most).
And is it possible that high court judgement may increase the sentence? (percentage probability?)
Dear Sir,
It is not known whether it is a conviction judgment or acquittal judgment. The High Court never give any next date of hearing but it gives a hint saying it may be posted after “4 weeks” etc. Your advocate must file a EARLY HEARING MEMO and get it posted on board. Further at the time of getting it posted your advocate must convince the concerned High Court judge that there is urgency to hear the matter. There is no minimum and maximum periods to dispose a matter pending before Constitutional Courts namely High Court and Supreme Court.
